Welcome to CLMADE. The terms “we”, “us” and “our” refer to CLMADE. CLMADE operates this online store and website, including its information, content, features, tools, products and related services, in order to provide customers with a curated shopping experience.

CLMADE is powered by Shopify, which provides the e-commerce platform that enables us to offer these services. Purchases made through this store are made directly from CLMADE and not from Shopify.

These Terms of Service, together with the policies referenced in them, explain the rights and responsibilities that apply when you visit the website, create an account, communicate with us or place an order.

By accessing or using the website, you agree to these Terms. If you place an order, you also agree to the policies made available during checkout, including our Privacy Policy and Return and Refund Policy.

Nothing in these Terms excludes or limits any mandatory consumer rights that apply in your country or region.

1. Eligibility and Customer Accounts

You must be at least the age of legal majority in your place of residence, or have the permission of a parent or legal guardian where permitted, to use the Services or place an order.

You agree to provide information that is accurate, current and complete when creating an account or placing an order. You are responsible for maintaining the confidentiality of your account credentials and for activity carried out through your account.

Please notify us promptly if you believe that your account has been used without authorisation. You may not sell, transfer or provide your account credentials to another person.

2. Product Information and Handmade Variation

We make reasonable efforts to present product descriptions, materials, dimensions, colours, photographs and other information accurately. Screen type, display settings, lighting and photography may affect how colours and surface details appear.

Some CLMADE products involve hand shaping, textile placement, assembly or finishing. Small variations in form, dimensions, colour placement, weave, texture or construction may occur between individual pieces. These natural variations are not automatically defects, but this does not affect your rights if an item is damaged, faulty or materially different from its description.

Product composition, supporting hardware and finishes vary by item. The information stated on the individual product page and order confirmation applies to the product purchased.

We may update product descriptions or discontinue products before an order is accepted. A later website update does not change the material terms of an order that CLMADE has already accepted unless the customer agrees or the change is required by law.

3. Orders and Acceptance

Submitting an order is an offer to purchase the selected products. An automated order-receipt message does not necessarily mean that the order has been accepted.

An order is accepted when CLMADE confirms acceptance, begins fulfilment or sends a dispatch confirmation, depending on the applicable transaction process.

We may decline or cancel an order before acceptance for reasons including product unavailability, payment authorisation failure, suspected fraud, incorrect pricing, shipping restrictions or an inability to fulfil the order lawfully.

If CLMADE cannot accept an order after payment has been collected, the applicable amount will be refunded to the original payment method.

Please review product selection, quantities, variants and delivery information before submitting an order. Eligible cancellation requests may be submitted through the customer account while the order remains unfulfilled. Cancellation and return rights are described in our Return and Refund Policy.

Consumer purchases are intended for personal or household use. Trade, wholesale and resale purchases require CLMADE’s prior written agreement and may be governed by separate commercial terms.

4. Prices, Currency and Payment

Prices, discounts and promotions may change before an order is accepted. The price applicable to an accepted order is the price shown during checkout and recorded in the order confirmation, subject to the correction of an obvious pricing error where permitted by law.

The amount payable is displayed during checkout and includes product charges, applicable taxes and duties, and free DHL Express shipping. No minimum order quantity or order value is required for free shipping.

Available currencies and payment methods are displayed during checkout according to the selected destination.

You agree to provide accurate billing and payment information and confirm that you are authorised to use the selected payment method.

Promotional offers may have separate eligibility periods and conditions. If promotional terms conflict with these Terms regarding that promotion, the specific promotional terms will apply.

5. Taxes, Import Duties and Customs

CLMADE covers applicable import duties, import taxes and ordinary customs-clearance charges for every order to a destination available at checkout. Customers should not be asked to pay additional routine import duties or taxes on delivery.

If a customs authority or carrier unexpectedly requests an import-related payment, contact CLMADE promptly and provide a copy of the notice or request so that we can review it before you pay.

Customers are responsible for providing accurate information required for delivery and customs clearance. Charges caused by an incorrect or incomplete address, a customer-requested change after dispatch, refusal, failure to collect, storage, redelivery or return are not ordinary DDP delivery charges and may be charged or deducted from a refund where permitted by applicable law.

6. Shipping and Delivery

Orders are dispatched from CLMADE’s supplier network in China and delivered to destinations available at checkout by DHL Express. Every order receives free DHL Express shipping, with applicable taxes and duties included and no minimum order quantity or order value.

Processing time is separate from transit time. The applicable processing estimate will be stated on the relevant product page, during checkout or in the order information before an order is accepted. Delivery estimates are not guaranteed arrival dates. Customs review, remote-area delivery, public holidays, weather, carrier disruption and other circumstances may affect delivery time.

CLMADE remains responsible for loss or damage during delivery until the customer, or a person designated by the customer, takes physical possession of the goods, where required by applicable consumer law.

If a customer independently selects and contracts with a carrier that CLMADE did not offer, risk may transfer when the goods are handed to that carrier, to the extent permitted by applicable law.

7. Returns, Refunds and Cancellations

Eligibility, request periods, return shipping responsibilities, handmade variation, damaged or incorrect orders and refund processing are governed by our Return and Refund Policy.

Nothing in these Terms removes any mandatory right to cancel an online purchase or seek a remedy for goods that are faulty, unsafe, not as described or otherwise non-conforming.

8. Care, Use and Safety

Customers should follow the product-specific instructions and our Care Guide. Materials and finishes vary between products, so general care information does not replace instructions supplied with an individual item.

DIY kits should be used only for their stated purpose and in accordance with their supplied instructions. Product-specific information about included materials, tools, skill level and any relevant safety precautions will be stated after verification.

CLMADE does not claim that a finished DIY surface is food safe, waterproof, heat resistant or dishwasher safe unless that property is expressly confirmed on the relevant product page.

9. Intellectual Property

The website and its original text, photographs, graphics, videos, designs, logos, product presentation and other content are owned by or licensed to CLMADE and are protected by applicable copyright, trademark, design and other intellectual property laws in China and other jurisdictions.

You may access the website for lawful personal use. You may not reproduce, republish, sell, distribute, commercially exploit or create derivative works from protected CLMADE content without prior written permission, except where applicable law permits otherwise.

CLMADE’s name, logo, designs and slogans may be protected as registered or unregistered intellectual property. Shopify’s names, marks and technology remain the property of Shopify or its licensors.

10. Third-Party Tools and Links

The Services may provide access to tools, payment services, delivery services, embedded functions or websites operated by third parties.

Third-party services are governed by their own terms and privacy practices. CLMADE is not responsible for the independent content or practices of a third-party website, except to the extent that responsibility cannot lawfully be excluded.

Please review the applicable third-party terms before using an external service or completing a transaction through it.

11. Relationship with Shopify

CLMADE is powered by Shopify, which enables us to provide the online Services. Any sale made through this store is a transaction directly between the customer and CLMADE.

Shopify is not the seller of CLMADE products and is not responsible for product descriptions, fulfilment, delivery or customer remedies relating to the sale, except for responsibilities Shopify separately assumes under its own terms or applicable law.

12. Privacy

Personal information collected through the Services is handled in accordance with our Privacy Policy.

Because the store is hosted by Shopify, Shopify also collects and processes certain personal information in order to provide and improve the platform. Information may be processed by Shopify and other service providers in countries different from the customer’s country of residence, as explained in the applicable privacy notices.

13. Reviews, Feedback and Submitted Content

If you voluntarily submit a product review, photograph, suggestion or other content, you confirm that you have the right to submit it and that it does not violate another person’s copyright, trademark, privacy or other rights.

You retain ownership of your original content. You grant CLMADE a non-exclusive, worldwide, royalty-free licence to use, reproduce, translate, adapt, display and distribute that content in connection with operating, improving and promoting CLMADE, subject to applicable privacy and consumer laws.

We may moderate or remove content that is unlawful, misleading, abusive, infringing, irrelevant or otherwise inconsistent with these Terms. We are not required to publish or respond to every submission.

14. Errors and Corrections

Website information may occasionally contain typographical errors, omissions or outdated information relating to product descriptions, availability, pricing, promotions, shipping charges or delivery estimates.

We may correct such information. If a correction materially affects an order that has already been accepted, CLMADE will notify the customer and provide any cancellation, refund or other remedy required by applicable law.

15. Prohibited Uses

You may not use the Services:

• for unlawful, fraudulent, malicious or misleading activity;
• to violate intellectual property, privacy or other legal rights;
• to upload malicious code or interfere with website security;
• to collect personal information about others without lawful authority;
• to send spam or unauthorised advertising;
• to impersonate another person or misrepresent your identity;
• to circumvent authentication, access controls, rate limits or robot-exclusion measures; or
• to use automated tools in a way that disrupts the Services or violates applicable permissions or law.

We may restrict or terminate access when reasonably necessary to protect customers, CLMADE, Shopify, service providers or the security of the Services.

16. Suspension and Termination

We may suspend or terminate website or account access where a user materially violates these Terms, misuses the Services, creates a security risk or engages in unlawful conduct.

Suspension or termination does not remove payment obligations that lawfully arose before termination. It does not affect accepted orders or mandatory consumer rights unless permitted by applicable law.

17. Service Availability and Consumer Rights

We aim to keep the website accurate and available, but website access may occasionally be interrupted or contain errors.

To the extent permitted by applicable law, the website and its general informational content are provided on an “as available” basis. This statement does not apply to obligations arising from an accepted order.

Nothing in these Terms excludes or limits warranties, guarantees, remedies or other rights that cannot lawfully be excluded, including rights relating to goods that are faulty, unsafe, not as described or not of satisfactory quality where those standards apply.

18. Limitation of Liability

Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, wilful misconduct, gross negligence, breach of mandatory consumer rights or any other liability that cannot lawfully be excluded or limited.

For consumer purchases, CLMADE is responsible for losses that are a foreseeable result of our breach of these Terms or failure to use reasonable care and skill. CLMADE is not responsible for losses that were not reasonably foreseeable or for business losses arising from a consumer purchase.

For business-to-business transactions, any additional limitation of liability will be stated in the separately agreed commercial terms.

19. Responsibility for Misuse

To the extent permitted by applicable law, you are responsible for losses directly caused by your unlawful misuse of the Services, infringement of another person’s rights or material breach of these Terms.

This section does not require a consumer to compensate CLMADE, Shopify or another party for losses caused by that party or for any obligation that cannot fairly or lawfully be imposed on the consumer.

20. Force Majeure

CLMADE will not be responsible for delay or failure caused by events outside its reasonable control, such as natural disasters, government restrictions, war, widespread transport disruption, carrier suspension, customs closure, power failure or major network interruption.

This section does not remove any right to cancel, receive a refund or obtain another remedy that applies under mandatory law when performance is delayed or becomes impossible.

21. Severability, Waiver and Entire Agreement

If part of these Terms is found to be unlawful or unenforceable, that part will be limited or removed only to the extent necessary, and the remaining Terms will continue to apply.

A delay in enforcing a right does not mean that the right has been waived.

These Terms and the policies incorporated by reference form the agreement governing use of the Services and consumer purchases, subject to the terms stated on the applicable product page, checkout and order confirmation.

22. Governing Law and Disputes

These Terms are governed by the laws of the People’s Republic of China, without depriving consumers of any mandatory protection available under the laws of the country in which they habitually reside.

For consumer disputes, the competent court and available dispute-resolution options will be determined by applicable mandatory law.

For business-to-business transactions, the courts with jurisdiction in Urumqi, Xinjiang, People’s Republic of China will have jurisdiction unless the parties agree otherwise in writing.

Before beginning formal proceedings, customers are encouraged to contact CLMADE so that we can try to resolve the matter directly. This does not restrict any right to contact a regulator, consumer-protection authority or court.

23. Changes to These Terms

We may update these Terms to reflect changes in our Services, business practices or legal obligations. The current version and its “Last updated” date will be posted on this page.

Material changes will be communicated where required by law. Changes will not apply retroactively to an order already accepted unless required by law or agreed with the customer.
